Ex-superintendent expected to return to Canada to face charges, report says

Brian Fogelson will “attend himself here on his own accord,” the Royal Canadian Mounted Police told a Nova Scotia newspaper.

Canadian authorities expect a former North Warren superintendent will soon return on his own to face allegations of sex crimes from 40 years ago, according to a media report.

Brian Fogelson, 61, will make an appearance in Nova Scotia’s provincial court “in the near future,” the Royal Canadian Mounted Police told LighthouseNow, a newspaper based in Bridgewater, Nova Scotia.

A warrant was issued June 10 for Fogelson on charges from 1975 and ’76 of indecent assault on a male, gross indecency with a male and sodomy.

Fogelson — recognized last year as Warren County’s superintendent of the year — retired in June after serving as North Warren Regional School District’s superintendent since 2008.

“We believe he’s going to attend here himself on his own accord,” Sgt. Derek Smith told LighthouseNow in a report Wednesday. “We had started the extradition process but in the meantime he’s aware of the allegations and we believe he’s going to come here to Canada … . Between he and his lawyer and the Crown, they’re just all making those arrangements now.”

The charges were filed in May. In June, Crown prosecutor Richard Tancock requested extradition — he said Fogelson typically visited Nova Scotia twice a year but stopped in 2013 after allegedly learning of an investigation into a co-defendant, who was sentenced in May.

Tancock told lehighvalleylive.com that “historical charges are not at all unusual,” but declined to elaborate on the 40-year gap.

The latest LighthouseNow report said Fogelson has retained an attorney from Halifax, Nova Scotia. The attorney, Stan McDonald, did not immediately return requests for comment.

A phone number at Fogelson’s most recent listed address in Blairstown Township was disconnected.

Fogelson got his start in education in Nova Scotia, teaching music to students from kindergarten through 12th grade for 13 years. He also was an administrator at Catasauqua High School and Delaware Valley Regional High School until leaving for North Warren.
